Biography

William J. (Bill) Mall, III is an experienced litigator with thirty years’ experience defending clients in California in a variety of cases.  He has handled commercial litigation, general liability, personal automobile liability, and trucking and transportation matters.  He represents businesses in general liability defense matters, as well as business disputes, including cases arising out of vehicle fleet operations, private vehicles used in deliveries, rental vehicles, and general personal injury matters arising out of the operation of a large vehicle fleet and work force performing work in consumer’s homes.  Bill’s clients include satellite television providers, restaurants, and large and small businesses, including retail establishments.  He also has experience representing businesses, including aerospace companies, in disputes that involve complex issues such as wrongful termination, sexual and other types of harassment and discrimination, and other employment issues facing his clients.

Bill has an extensive background in the defense of medical malpractice matters which has given him an understanding of complex medical issues and experts that is extremely useful in the defense of personal injury claims, from simple injuries to catastrophic injuries.

Bill’s litigation experience includes many trials and binding arbitrations. His experience includes several jury trials. These trials consisted of his defense of several personal injury claims, including catastrophic injuries; discrimination claims, including a federal civil rights jury trial; and business litigation.  Most recently, he tried two separate auto versus bicycle personal injury cases, both involving an opened vehicle door allegedly causing substantial injuries in both cases.  Despite a California Vehicle Code section placing liability for such actions on the party opening the door, in one case, he obtained a verdict awarding only $1200.00, despite a documented low back surgery after the accident.  In the other, the verdict was within $12,000 of the pretrial offer to settle.  Of course, both cases involved unique facts and neither can be extrapolated to predict results in other cases.  

With decades of experience in business litigation matters, Bill is able to assess general liability, business disputes, and employment-related matters at the outset, considering the facts as known, as well as the ramifications of various approaches to litigation, be it settlement, vigorous litigation, or a combination of both approaches.  This enables him to evaluate disputes and rapidly assist his clients to decide the most appropriate response to any situation.  He works closely with General Counsel and claim representative, as well as directly with front line employees and insureds, to formulate a case-by-case response to each matter, as well as overall approaches to litigation in general.  His attentiveness to and responsiveness to the individual wants, needs, and litigation philosophy of his clients ensures that his client’s expectations and goals are met every time in every case.
